Booking Conditions
The following terms rule the contractual relationship between you, as tenant, and us, ferienhausprovence (FHP).
Booking, confirmation and payment
1.1 With your registration you offer us the conclusion of a contract. Please fill in completely the registration form and send it to FHP. The registration form is to be filled in by one person, who is thus acting for all participants listed in the registration form. Then, by return of e-mail or by letter, FHP will send you a confirmation of your registration including your name, address, the rental period determined, the number of booked persons as well as the rental price. Oral agreements have to be made in a written form to become legally valid.
1.2 If the contents of the registration confirmation differs from the contents of the registration, this represents a new offer of FHP. The formation of the contract is based on this new offer. The client confirms the acceptance by payment or down payment.
1.3 Once you have received the registration confirmation, a down payment representing 30% of the total rental price will become payable by transfer instruction within 10 days. Until such time as the down payment has been received, the property will still be available for others to rent. The final payment, without any request to pay, is due 8 weeks before the beginning of the rental period. Should the booking be made within 8 weeks of the arrival date, then the full amount of the rental monies will be due. Without a complete payment the use of the holiday house may be refused. In case of non-compliance with the term of payment we reserve the right to withdraw from the contract. Cancellation charges will apply (see below).
1.4 If payments are effected from abroad, please take care that it is effected completely, without bank-charge deductions.
1.5 If the client, during his stay, wishes to prolong his tenancy he has to pay the additional rent to FHP.
Services, Liability
2.1 The complete contractual services are listed in the description of your holiday house. The furnishings and equipments are subject to changes.
2.2 FHP is not liable:
a. in cases of force majeure, such as
war, civil war, fire, water, epidemics, strike, vermin infestations,
sovereign dispositions, nuclear energy...etc
b. for local
circumstances, that do not concern directly the holiday domicile or
for impairments from the surroundings that cannot be foreseen,
c.
for all indications and events that do not directly concern the
rented object, as for example theft,
d. in case of the breakdown
of the supply of public utilities including water, gas, telephone
and electricity or of the swimming pool filtration system.
Overcrowding, pets, duty to cooperate
3.1 The holiday domicile may only be occupied by the persons
named in the registration. Children and babies count as full
persons. Please be aware that, in case of overcrowding, an extra
charge becomes due or that the surplus persons can be asked to leave
the house. We also consider as overcrowding the installation of
caravans and/or tents on the property of the house as well as
short-term overnight-guests as far as this exceeds the number of
persons mentioned in the booking confirmation. Oral agreements have
to be made in a written form to become legally valid.
3.2 We ask the tentant to take care of the holiday home. Should the tenant, when occupying the object, ascertain defects, he is categorically obliged, within the scope of the legal dispositions, to undertake all the acceptable activities in order to contribute to the repair and to minimize possibly occuring damage. The tenant must immediately notify FHP or our representant his reclamations to allow an examination of the damages, and, if possible, their elimination. We will of course do our utmost to ensure that any problem is dealt with efficiently and as soon as is practical.
3.3 On arrival, you will be given an inventory of the property and this will be checked on departure. Should there be any accidents during your stay, we would ask for replacements of similar quality be made during your stay and reported to FPH or our representant on your departure.
3.4. Pets are allowed with prior agreement. In this case please assure that they do not stay on chairs, in beds or in the pool.
Cleaning and additional costs
4.1 Before you depart, please do the dishes and leave your holiday house in a well-swept condition and with all the furnishings.
4.2 Under this condition the full end of stay cleaning is included in the price.
4.3 During the heating period, heating costs arise. They are directly charged, according to the consumption.
Security deposit
5.1 Please do give at your arrival the security cheque as an open cheque (for example: eurocheque) to FHP or to our representant. With this security cheque you are liable for possible losses, defects, or damages of the domicile and the furnishings. If there are no damages, you will receive your canceled security cheque two weeks after your departure by post.
5.2 In case of damages, please inform FHP or our representant, try to find a direct agreement or, as the case may be, inform your liability insurance. After the damage has been handled, you will immediately get back your security cheque.
Cancellations
and change in
reservations
6.1 Before the beginning of the tenancy, the client may, at any time, withdraw from the rental contract in a written form. We recommend to send a e-mail of cancellation.
6.2 If the cancellation is effected up to 90 days before the occupation of the domicile by yourself, VP charges 15% of the payment on account before reimbursement; if cancellation is made by VP you receive back your payment on account plus 15%. If the cancellation is effected up to 60 days before the occupation of the domicile, VP charges 100%. We recommend our clients to conclude travel withdrawal insurance. Please observe the insurance conditions as stated in the category “insurances”.
6.3 If the tenant does not occupy the rented object, if he arrives there late or if he, for reasons that are not part of our responsibility, leaves before the rental contract expires, FHP has full claim for remuneration.
6.4 If the tenant, in spite of a warning notice, gravely disturbs
the tenancy, FHP may withdraw from the contract without observing
any time limits (for example: Overcrowding, no respecting the house
regulations, careless damage of the house). In specially grave cases
a warning notice is not required. In such a case, we are not obliged
to reimburse amounts already received.
Insurances
7. We recommend the tenant to additionally conclude, at his own expenses, a travel withdrawal insurance, a liability insurance, a personal accident insurance, health insurance, luggage insurance.
